What is this exception you are talking about? My reading of the letter of intent that we signed is that my daughter owes them a 1 year commitment to attend the school. As I understand it, if my daughter transfers before the end of the year she has to sit out next year. I have also been advised that in order to even talk to other coaches she must get a release and asking for that release can make a situation go bad pretty soon. Another question, is if my daughter quites the team but stays in school does she loose the athletic money immediately and we now responsible for the tuition for the balance of this semester and the next?

She does need to get a release to speak with other coaches. She will need to target the schools she wants to speak with and the sending coach/school will have to agree. I have heard that you can post a general release someplace on the NCAA website but I never saw this done (not did I look too hard.) The releases get faxed to the potential transfer schools usually. Yes a bad situation can get worse but you'd think they'd want to know sooner rather than later that moeny will be freed up.
Whether she loses the athletic money right away depends on the coach/school/AD and perhaps if there were an infraction that mandates such loss (I only know of one child quiting and the deal was he kept the money through the remainder of the year.)
