    Who Will Stand Up for Civil Liberties?

    At a moment in history when the ACLU is quickly becoming a partisan left-wing advocacy group that cares more about getting President Trump than protecting due process (see my recent op-ed in the Wall Street Journal), who is standing up for civil liberties?

    The short answer is no one. Not the Democrats, who see an opportunity to reap partisan benefit from the appointment of a special counsel to investigate any ties between the Trump campaign/ administration and Russia. Not Republican elected officials who view the appointment as giving them cover. Certainly, not the media who are reveling in 24/7 “bombshells.” Not even the White House, which is too busy denying everything to focus on “legal technicalities” that may sound like “guilty man arguments.”

    Legal technicalities are of course the difference between the rule of law and the iron fist of tyranny. Civil liberties protect us all. As H.L. Mencken used to say: “The trouble about fighting for human freedom is that you have to spend much of your life defending sons of bitches: for oppressive laws are always aimed at them originally, and oppression must be stopped in the beginning if it is to be stopped at all.” History demonstrates that the first casualty of hyper-partisan politics is often civil liberties.

    Consider the appointment of the special counsel to investigate “any links and/or coordination between the Russian government and individuals associated with the campaign of President Trump.” Even if there were such direct links, that would not constitute a crime under current federal law. Maybe it should, but prosecutors have no right to investigate matters that should be criminal but are not.

    This investigation will be conducted in secret behind closed doors; witnesses will be denied the right to have counsel present during grand jury questioning; they will have no right to offer exculpatory testimony or evidence to the grand jury; inculpatory hearsay evidence will be presented and considered by the grand jury; there will be no presumption of innocence; no requirement of proof beyond a reasonable doubt, only proof sufficient to establish the minimal standard of probable cause. The prosecutor alone will tell the jury what the law is and why they should indict; and the grand jury will do his bidding. As lawyers quip: They will indict a ham sandwich if the prosecutor tells them to. This sounds more like Star Chamber injustice than American justice..... The Founders would be turning over in their graves if they saw what they intended as a shield to protect defendants, turned into a rusty sword designed to place the heavy thumb of the law on the prosecution side of the scale.... So I will be standing up for civil liberties for the duration of this investigation. As a civil libertarian, I care more about due process and the rule of law than I do about politics.

        A little girl was leaning into a lion's cage. Suddenly, the lion grabs her by the collar of her jacket and tries to pull her inside to slaughter her, all under the eyes of her screaming parents.
        A biker jumps off his Harley, runs to the cage and hits the lion square on the nose with a powerful punch. Whimpering from the pain the lion jumps back letting go of the girl and the biker brings the girl to her terrified parents, who thank him endlessly. A reporter has watched the whole event.
        The reporter addressing the Harley rider says, "Sir, this was the most gallant and bravest thing I've seen a man do in my whole life."
        The Harley rider replies, "Why, it was nothing, really. The lion was behind bars. I just saw this little kid in danger, and acted as I felt right."
        The reporter says, "Well, I'll make sure this won't go unnoticed. I'm a journalist, you know, and tomorrow's paper will have this story on the front page. So, what do you do for a living, and what political affiliation do you have?"
        The biker replies "I'm a U.S. Marine, a Republican and I voted for Trump".
        The journalist leaves.
        The following morning the biker buys the paper to see if it indeed brings news of his actions, and reads, on the front page:
        ** U.S. MARINE ASSAULTS AFRICAN IMMIGRANT & STEALS HIS LUNCH.

        And THAT pretty much sums up the media's approach to the news these days.

            Following the horrific terror attack in Manchester, England, President Trump slammed the terrorists behind the bombing, calling them "evil losers."

            On "The View" on Tuesday, some of the co-hosts took issue with Trump's remark.

            Sunny Hostin said using the term "evil losers" was not presidential.

            "Harkening back to President Obama, who talked about the victims and didn't talk about the bombers necessarily ... and talked about how we as a society have to come together. I was expecting something like that," Hostin said.

            Whoopi Goldberg agreed, saying she wants the president to be "one step above."

            "I want him or her to be one step above and I don't want them talking like I would talk," Goldberg said.

                If one can be considered a "foreign agent" by wittingly or unwittingly acting in the best interest of a foreign government or foreign peoples...doesn't that make the entire Democratic party a bunch of foreign agents?

                      Here is what makes you a foreign agent -

                      Take half million from foreign govt and don't breathe a word.

                      Then, using your position of influence as NSA, you make decisions that look out for best interest of govt that bought you.

                      Without telling our citizens.

                        Yeah sure, Sunny and Whoppi ( sounds like a porno flick that no one would touch ) would rather Trump use terms like " workplace violence " , or as Loretta ***** stated, we don't know why it was done ( Orlando Massacre )

                              Just real surprising how superficial these "Progressives" have become. So much interest in others diets, modeling careers, hands, neck colors, if they've reached the highest levels of education, income level; they vote based on skin color and gender.
