Because its not a big deal. The Timbers and now separate ownership Thorns can spend their money how they see fit.

Even with the ability to protect four players, who says you have the right to demand they fully fund their youth academy. Its their money.

Back when Peregrine owned the Thorns, there was a legit equal-opportunity question (though as Title IX does not apply to professional sports, it was more of a moral question than a legal one).
Now that Thorns are owned by someone else, that question pretty much vanishes.
It would be great if Thorns did become a free academy. It also would be great if there were a female version of MLS Next, but there isn't, so ECNL will have to do.
But even if you gotta pay, they're still the best game in town on the girls' side.

For colleges and universities, the government says they have to. (But NIL money will fix that!)
For pro soccer in Europe, many of the national federations say the pro teams have to.
Nobody in the US says pro teams have to.
