Still pending. Scheduled for trial starting 9/4/24. Lots of motions pending between the parties, including the Timbers' motion to add a punitive damages claim against Tara Bilanski, etc. The case has to be generating an embarrassing (or perhaps shameful) amount of attorney fees.

If apex gets shut down, and that is a strong if, a new club will emerge . They aren’t going back to bend fc that’s for sure. So all of this is a waste and only making the attorneys money.

That's fore sure. Bend FC already has a judgment in the amount of $107K against Bilanksi, which is the result of her attempting a counter-lawsuit against the Club and losing. That judgment is stayed on appeal. Meanwhile, Bend FC's lawsuit against Apex and Bilanski is barreling towards a September trial, with Bend FC currently seeking $1.1 M in damages and asking the court to add a claim for punitive damages. Separate from the damages, just looking at teh volume of filings in the court docket, it's clear both sides have spent hundreds of thousands of dollars on legal fees. If they go to trial, the collective fees will likely hit seven figures!
