    Any information which is a) non-public (meaning "can't be readily obtained for a minimal cost from published sources") and b) gives a business a competitive advantage, can be treated as a trade secret. A mailing list of soccer families, like any customer contact list, would qualify. And OYSA's lists probably aren't sufficiently "public" to be an adequate replacement, though that would be something for the judge and/or jury to decide.

    And there's no law that says non-profits cannot have trade secrets.

    That said, the main cause of action for BTFC appears to be embezzlement, along with a claim for punitive damages.

      I can see the investigating the charges of embezzlement, that is awful and hope as in the case of WUFC are not true. The OYSA list is very available to the public for a nominal fee.

        From what I read, the payments were authorized by the board? If the payments and financials were presented to the board and they approved, then aren't they approving the disbursements?
        Taking mailing lists from a youth soccer non-profit organization? The mission of the non-profit is to serve the community and kids. Therefore if someone is serving those kids, shouldn't the non-profit be happy about that? Now if someone took donor lists and took funding away and it hurt the non-profit's ability to serve the community and kids I could see it, but mailing lists, no.
        This all sounds like a personal matter and personal feelings.
        It is an unfortunate situation all around.

          If the payments are authorized, then there should be some documentation, contracts, meeting minutes stating so. That's the whole purpose of a board is to document the business of the non-profit. I don't think Bend Timbers would go through this much if there was documented evidence that these were authorized payments. And why would the alleged conspirators wonder (in documented text messages) how to get paid? Wouldn't they just go to the board and say "Hey, we had a great year, here's our payout." and life would be easy.

          I agree about this being an unfortunate situation all around. Kids lose in this case, and club soccer proves again that adults can ruin anything if given enough time.

            Let’s not get OYSA mixed up with an entity that actually works for their pay check.

            Let’s also not forget about the corrupt and POS board members at bend who were trying to get their kids coach a raise.

              The case is about embezzlement and stealing trade secrets. If people did these things in response to board members wanting their coach to receive extra pay that is unfortunate because that is not a defense.

              The defendants are going to have to prove they did not embezzle and or steal trade secrets.

                So it’s true that the board members are snakes and tried to use their influence to get their joke of a coach a raise? Sounds like Bend Timbers to me.

                Steal trade secrets? Really. Let me know when Bend Timbers had any secret worth taking besides a corrupt board.

                  Good thing this is going to be adjudicated in a proper setting (civil or criminal court) as opposed to here on TS.

                  I don't know anyone involved, but man, the Apex guys are absolute idiots. Everything is tracked online, everything! Get some burner phones for ****'s sake. Even if they aren't guilt of embezzlement and theft, they are guilty of being dumb as ****.

                          As a former employment attorney, I've seen many cases of employees stealing customers and trying to disable former employers to give themselves a competitive advantage in starting their own firm, or in this case, club. Spoiler alert, it never ends well for the list stealers. If the messages and computer logs are all true, it shows that the former employees at Bend Timbers who started the new club took some real steps toward financially and administratively disabling Timbers. The only agenda here seems to be of those who wanted to hurt Bend Timbers for personal and financial reasons.

                          I'm just glad we moved so we don't have to deal with all of this.
