WUFC attorney John Davis of ***** Murphy McLane LLP be disciplined by the Oregon Bar

According to the lawsuit against WUFC, John C. Davis of ***** Murphy McLane LLP wrote in a letter:

“Mr. ****** himself, while a board member, and without authorization from the Board, contacted the Oregon Department of Justice (Charities Division) in an attempt to get the DOJ to investigate the club – clearly a violation of his fiduciary duties.”

How could any legit lawyer write this? Davis wanted the board member to ask permission to report financial crimes that the Board tried to cover up? And THIS was a VIOLATION of his fiduciary duty?This is literally what you would want a board member to do in the situation, go to the DOJ. This would be them upholding their fiduciary duties. Crazy. Reading through some of the lawsuit and discovery documents, it would not be insane to think that there could be some discipline against Davis and his firm and possibly a malpractice lawsuit brought by parents and members of WUFC. He seems to either be incompetent or just trying to cover things up. How much of the public’s money is the nonprofit entity (soccer club) wasting on defending this suit?

You’d be hard-pressed to find a lot of people in the community who earnestly like him. Has always been kind of a weirdo imo but does not seem like a bad guy and that’s just based off of my interactions with him at our church. Big running joke in the community is he prays to God on Sundays, and kicks kids out of local soccer clubs on Mondays.

He is the exact opposite of a “counsel.” Just a paper pusher who has mishandled issues for two nonprofit soccer clubs serving rich white folk in west linn and who is now trying to dig his way out while billing both clubs. Looked up the docket and can’t believe he wrote that the board member was removed because they went to the DOJ. Does this guy not know what whistleblower retaliation is? How do you make such egregious mistakes as an veteran attorney?

What is this all about. Did WUFC take public money?

Ask John Davis, Mr. “Board of Trustee Chair and Executive Committee Chair” of Oregon Tech (Oregon Institute of Technology)”.

Everything is on the Willamette United Football or Soccer Club or whatever website in their board meeting minutes. Davis thought it was a good idea to try to shut the whistleblower up by kicking him off the board and kick his 4 kids out of the club.

What kind of cruel person kicks little kids out of a soccer club to cover up mistakes he made in addressing financial crimes?

Chiming in as a parent of a WUFC/OPFC player: kicking kids out of the soccer club for any reason is against everything our soccer community stands for. In those case, per the court filing, the kids were 5, 7, 10 and 11 years old. This is just so ugly

Even if the person who is alleged to have been the whistleblower had himself committed the financial crimes, we still wouldn’t have taken action against his family. There is a large faction of families that disagree with the actions of the Board of Directors and John Davis, but most of us fear retaliation for our own families so we are hesitant to speak up. We are optimistic that the DOJ will clean house eventually and Davis’ unconscionable direction is brought to light. Already, many families have left the club as a result of the retaliation against the family and many more will follow. The club refused to release the children to play for other soccer clubs by holding their “player cards” as ransom until the parents completed fulfillment of all fees despite the players not staying the entire season.

The reason for all of this is that there was $100,000’s of embezzlement and misappropriation (plus forgery by an individual still employed by the club) and the board members refused to acknowledge any of it; in fact, they lied and hid everything about it. This is a nonprofit so this is all the public’s money.

All of this under Davis’ watch and most of it orchestrated by him. Now the DOJ and IRS are investigating everything and the club refuses to even inform its membership of any of this despite it being visible in court filings and peer sharing.

John Davis coached my kids’ basketball team. Something always seemed off about him. Like had he something to hide… could never put my finger on it. Just bad energy

Just based on the court docs, seems like his firm has badly mishandled issues at these soccer clubs. Seems like the board royally messed up, tried to make it all go away by axing a board member/his family from the organization but dug themselves a deeper hole by not anticipating pushback. Who knows how much of this is all true, but Davis putting in writing that removal of a board member was at least in part due to whistleblowing is something i just can’t comprehend any ethical lawyer ever doing.

Does the club lawyer have an obligation to inform the club membership of a DOJ investigation? Should he implore the board to do so? Some conflict here considering the fact that longer the club fights the lawsuit the more he can bill. Also, if club - aka public - money is being used to a defend a lawsuit and respond to the DOJ, they should let the membership know what they are doing with its money. Nonprofit rules are different.
