MASSACHUSETTS DEFAMATION LAWS
MA Law on Defamation:
“A plaintiff alleging libel must ordinarily establish five elements: (1) that the defendant published a written statement; (2) of and concerning the plaintiff; that was both (3) defamatory, and (4) false; and (5) either caused economic loss, or is actionable without proof of economic loss.”
Defamation is the act of falsely or unjustifiably injuring the good reputation of another by making malicious statements that are untrue or misleading against that person. In order to make a claim of defamation in a Massachusetts court of law, a false and defamatory communication must have been made against a person that was published, meaning that it was made to a third party, or shown to a third party and it must have resulted in damage to his or her community reputation. Damage to a person’s community reputation means that the statement resulted in that person being ridiculed, hated, or held in contempt or caused damage to the person’s business or trade.
Defamation lawsuits always involve libel or slander. Libel is defamation through pictures or written or printed words. Slander is a spoken statement that is defamatory.
In the state of Massachusetts, after a defamation lawsuit has been filed, the injured party, called the plaintiff, must prove that the false statement was, at the very least, negligence in order to prevail. The plaintiff does not have to prove that he or she suffered economic losses as a result of the defamation. If the plaintiff is a public figure, he or she must also prove actual malice. This means that the public figure must prove that the defamation was made with the knowledge that it is was false or was made with reckless disregard of whether it was true or false.
In general, if the defamation was substantially true, the injured party cannot file a defamation lawsuit. This means a statement or publication does not have to be perfectly accurate to be considered true. For example, if a person states that another person was convicted of drunk driving three times when that person was only convicted one time, the statement will be considered to be substantially true.
Most states have statute of limitations that limits the amount of time that a person has to file a lawsuit. In the state of Massachusetts, a defamation claim must be filed in a court of law within three years from the time it was uttered or published.
