Because they can and have the numbers to do so. Every other club can also if they have the numbers

I actually don't think they should be made to choose, but the options should be available to others if they have the quality and numbers to support it. Let's be real...that only means another club or two (and I'm not associated with a club that has either).
It's my impression the commitments are different for each, so if you have the depth and interest to fill teams fitting both category, go for it.

Give it time - neither league wants clubs doing both. At some point both will force the few clubs who have both (and it's not that many) to choose. However, the club who have both are generally very good, have the player base to justify both, and have some political clout. If they want both they will fight to have both.

I doubt it. These guys expended substantial resources creating ECNL. Filling a void when Red Bull or whatever "elite" alphabet league proceeded them. It is entirely appropriate for them to benefit from their efforts.
I think all these national leagues are negative for US soccer and player development. But gotta give credit to these guys from a business perspective.
